1. Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel appearing on behalf of the informant.

2. The petitioner seeks bail in a case registered for the offences punishable under Sections 341, 323, 326, 307, 504, 506/34 of the Indian Penal Code.

3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is in custody since 19.06.2024.

4. The informant alleges that on account of dispute relating to land, accused persons came and assaulted her son and when her husband came to save her son, accused persons assaulted him and Upendra Singh assaulted the husband of the informant by Gahadal causing fracture on his waist.

5. Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.52586 of 2024(3) dt.21-09-2024 2/2 petitioner has been falsely implicated in the instant case by the informant. It is further submitted that specific allegation of assaulting the husband of the informant is against Upendra Singh causing grievous injury and as far as this petitioner is concerned, the allegation against him is general and omnibus in nature.

Learned A.P.P. for the State and learned counsel appearing on behalf of the informant opposed the prayer for regular bail of the petitioner but then is not in a position to rebut the submission of the learned counsel for the petitioner that allegation of assault is general and omnibus in nature.

7. Considering the submissions made by the learned counsel for the petitioner, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Shiv Sagar P.S. Case No. 50 of 2024.
