JUSTICE SUDHIR SINGH ORAL ORDER 27-10-2015 Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case instituted under Sections 147, 148, 149, 341, 307, 324 and 302 of the Indian Penal Code.

Allegation against the petitioners is that they along with other accused persons assaulted and gave knife blows to informant and her son. As a result of which, in course of treatment, her son died.

It has been submitted on behalf of the petitioners that they have got no criminal antecedent. They are in custody since 25.6.2015. Chargesheet has been submitted in the present case. There is no allegation of tampering of evidence against the petitioners. From perusal of paras-5, 6, 11, 12 and 15 of the case diary it is evident that the main allegation of assault upon the deceased is against co-accused Sadre Alam and Badre Alam. From perusal of the aforesaid paras of the case diary it would appear that there is no allegation of causing any injury upon the

Patna High Court Cr.Misc. No.40697 of 2015 (3) dt.27-10-2015 2 / 2 deceased against the petitioners. Petitioners are ladies. On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, in connection with Parihar P.S. Case no. 111 of 2015.
