1. Heard the parties.

2. Petitioner seeks regular bail in connection with Banjariya P.S. Case No. 136 of 2024 dated 16.06.2024 registered for the offence(s) punishable under Section(s) 272, 273, 414 of the I.P.C. and section 30(a) of Bihar Prohibition & Excise Act.

3. Mr. Priyesh Kumar, learned counsel for the petitioner submits that the instant matter relates to the recovery of 25 litres of country made liquor and the same is alleged to have been recovered from the possession of this petitioner and co-accused Biru Sahni. In fact, the petitioner was a passer-by and he has falsely been implicated by the police and he had no connection with the alleged seized motor cycle. It is further submitted that petitioner has got fair and clean antecedent and

4. Mr. Khurshid Anwar, learned APP appearing for the State opposes the bail prayer.

5. Considering the above submissions and mainly taking into account the petitioner's fair and clean antecedent and completion of investigation against him, this court is inclined to release him on bail. Accordingly, let the petitioner named-above be released on bail in connection with Banjariya P.S. Case No. 136 of 2024 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
