JUSTICE ARUN KUMAR ORAL ORDER 30-03-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody since 06.12.2017, seeks bail in connection with NDPS P.S.Case No. 19 of 2017 arising out of Dehri (Town) P.S.Case No. 304 of 2016 registered under Sections 8/20 (b)(ii)(c)/25 of the N.D.P.S.Act. Allegation against the petitioner in brief is that 5 Kg 700 g Ganja was recovered from his flat.

Submission is that alleged so-called recovery is made in absence of the petitioner and it's a small quantity even the procedure of seizure was not followed and copy of the same was not given to any of the family members and petitioner has no criminal antecedent.

Having considered the aforesaid facts and circumstances, the petitioner, namely, Naresh Prasad Gupta, is directed to be

No.18308 of 2018 (2) dt.30-03-2018 2/2 released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-IV, Rohtas at Sasaram in connection with NDPS P.S.Case No. 19 of 2017 arising out of Dehri (Town) P.S.Case No. 304 of 2016.
