The petitioner seeks bail in connection with Obra P.S. Case No. 82 of 2021 instituted for the offences under Section 392 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 03.05.2021, charge-sheet has been submitted in the case and has antecedent of nine cases. It is further submitted that petitioner stands acquitted in seven of the cases and is a man aged about 60 years.

Learned counsel for the petitioner submits that allegation in the F.I.R. is of looting vehicle along with Rs. 5,000/-, two mobiles and gold chain of the informant by three

Learned counsel for the petitioner submits that the F.I.R. was against unknown, the name of the petitioner transpired in the confessional statement of co-accused, the petitioner was not put on T.I.P. nor recovery of any incriminating article was made from the petitioner. Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted in the case, he was not put on T.I.P. and no recovery was made from him, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Daudnagar in connection with Obra P.S. Case No. 82 of 2021 with a condition that one of the bailors shall be the brother of the petitioner, Nagendra Singh.
