Heard the learned counsel for the petitioner and the learned APP for the State.

The present petition is by way of third attempt at the behest of the petitioner for grant of regular bail in connection with Bidupur PS case no. 286 of 2018, registered under Sections 394, 302, 396 of the Indian Penal Code, inasmuch as earlier, the prayers of the petitioner for grant of bail were rejected by this Court vide orders dated 11.04.2022 and 22.02.2023, passed in Cr. Misc. no. 33752 of 2021 and Cr. Misc. no. 6373 of 2023 respectively.

Learned counsel for the petitioner has submitted that co-accused Deepak Kr. Singh, in whose confessional statement, name of the petitioner transpired, has already been

Patna High Court CR. MISC. No.49604 of 2023(5) dt.24-11-2023 2/2 granted bail by a co-ordinate Bench of this Court vide order dated 19.07.2019, passed in Cr. Misc. no. 13408 of 2019. He further submits that other co-accused persons have also been granted bail by co-ordinate Benches of this Court. 4.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the parties and taking into account the fact that the other co-accused persons have already been granted bail by co-ordinate Benches of this Court and the petitioner is in custody since 12.11.2020, I deem it fit and appropriate to admit the petitioner to the privilege of bail.

Accordingly, the abovenamed petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned court of Additional Sessions Judge-XI, Vaishali at Hajipur in connection with Bidupur PS case no. 286 of 2018.
