Petitioner, already in custody, seeks bail in connection with Dhaka (Pachpakari) P.S. Case No.330 of 2017, registered under Sections 379, 411, 413 and 414/34 of the Indian Penal Code. Allegation in brief is that the petitioner was caught red handed while stealing away the motorcycle of the informant in the midnight and leading to his confessional statement, three other stolen motorcycles were recovered.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 28.09.2017.

Having considered the aforesaid facts and circumstances, the prayer of bail of the petitioner is rejected in connection with

Patna High Court Cr.Misc. No.15140 of 2018(2) dt.20-03-2018 2/2 Dhaka (Pachpakari) P.S. Case No.330 of 2017 pending in the court of learned SDJM, Sikrahana at Dhaka, East Champaran. However, the trial court is directed to expedite the trial and preferably conclude the same within nine months after framing of the charge.
