Asha Verma, learned counsel who was assisted by Sri Ranvijay Narain Singh, learned counsel for the petitioners and Mr. Zainul Abedin, learned A.P.P. Four petitioners apprehending their arrest in connection with Complaint Case No. 564 of 2012 registered for the offence under section 147, 148, 149, 341, 323, 504, 380 of the Indian Penal Code have prayed for grant of anticipatory bail. Learned counsel for the petitioners submits that petitioners and complainant are gotiyas and only due to old animosity the present complaint was filed. It has further been argued that save and except Section 380 of Indian Penal Code
Patna High Court Cr.Misc. No.26580 of 2016 (2) dt.04-07-2016 2/2 which has been incorporated in the complaint petition F.I.R. other sections are bailable. By way of referring to the order of the learned Sessions Judge she has argued that even the learned Session Judge has raised doubt on the allegation of theft. Learned A.P.P. has opposed the prayer of bail. In view of the nature of accusation and the fact that it was a complaint case, in the event of arrest or surrender within a period of six weeks from today, let the aforesaid petitioners namely Udit Kumar @ Teni Singh, Shatrughan Singh, Sheo Bachan Singh and Shailesh Singh be enlarged on bail on furnishing bail bond of Rs. 10000/- (rupees ten thousand ) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad (Bihar) in connection with Complaint Case No. 564 of 2012 subject to conditions as contemplated under section 438(2) of the Code of Criminal Procedure.
