The petitioner is apprehending his arrest in connection with Bhagwanpur P.S. Case No. 88 of 2017 registered for the offences punishable under Sections 467, 468, 471, 420 and 120B read with Section 34 of the Indian Penal Code. As per prosecution case, the petitioner got appointment as Niyojeet Teacher on the basis of forged and fabricated certificate and mark-sheet and was getting salary.

Patna High Court CR. MISC. No.50180 of 2022(2) dt.03-01-2023 2/3 Learned counsel for the petitioner has submitted that the petitioner is innocent and has been falsely implicated in this case. From perusal of the F.I.R. it transpires that the allegation against this petitioner is of obtaining job as a Niyojeet Teacher on the ground of forged documents in the year 2012 and on the basis of aforesaid allegation, he was terminated from service. The similarly situated co-accused persons have been granted anticipatory bail as well as regular bail by different Coordinate Benches vide orders dated 24.04.2018, 04.07.2018, 30.07.2018, 01.08.2018, 06.08.2018, 10.08.2018, 10.08.2018, 14.08.2018, 22.09.2020 and 27.07.2022 passed in Cr. Misc. No. 10989 of 2018, Cr. Misc. No. 38747 of 2018, Cr. Misc. No. 39078 of 2018, Cr. Misc. No. 43715 of 2018, Cr.

Misc. No. 44080 of 2018, Cr. Misc. No. 39268 of 2018, Cr. Misc. No. 43367 of 2018, Cr. Misc. No. 47368 of 2018, Cr. Misc. No. 23895 of 2020 and Cr. Misc. No. 9330 of 2022, respectively. The petitioner has got clean antecedent as stated in paragraph 3 of the bail petition.

Learned counsel for the State and learned counsel for the vigilance have opposed the prayer for anticipatory bail of the petitioner.

Considering the aforesaid facts and circumstances of

No.50180 of 2022(2) dt.03-01-2023 3/3 the case, let the above named petitioner, in the event of his arrest/ surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 20,000/-(Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Bhagwanpur P.S. Case No. 88 of 2017, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.

The application stands allowed.
