Perused the impugned order dated 30.05.2016 passed by Subordinate Judge-II, Sitamarhi in Title Suit No.215 of 2015 whereby the learned court below has allowed the intervention application filed by purchasers of part of the suit property. According to the learned counsel, the purchasers have already purchased part of the suit property in the year 1979. The court below in the impugned order held that since they have purchased the property, they have got right, title and interest in the suit property.

In view of the facts and circumstances of the case, in my opinion, the court below has rightly exercised the jurisdiction vested in it by law under Order 1 Rule 10 of the Code of Civil Procedure.

Thus, I find no reason to interfere with the impugned

Patna High Court C.Misc. No.586 of 2016 (2) dt.19-09-2016 order in exercise of supervisory jurisdiction. Accordingly, this civil miscellaneous application is dismissed. (Mungeshwar Sahoo, J) Harish/- U
