The petitioner seeks bail in a case registered under Section 379/511/34 of the Indian Penal Code.

Allegedly, the petitioner was trying to unlock the motorcycle of the informant with help of the key, parked in front of his house and in consequence thereof, one of the accused was caught hold of.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 22-05-2019. Charge sheet has already been submitted. The petitioner has been made accused in the present case due to mistake of fact. The petitioner had no

Patna High Court CR. MISC. No.46171 of 2019(2) dt.30-07-2019 2/2 intention to commit theft. The allegation, made in the FIR is denied by the petitioner.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur at Ara in connection with Sahar P.S. Case No. 129 of 2019.
