1. Heard learned counsel for the petitioners Ms. Eashita Raj and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 191(3), 190, 126(2), 115(2), 118(1), 109, 351(2), 352 of the B.N.S.
3. Learned counsel for the petitioners submits that petitioner no.1, 3, 4 and 5 have antecedent of one case,
Patna High Court CR. MISC. No.49416 of 2025(2) dt.11-08-2025 2/3 petitioner no.2, 6 and 7 are persons with clean antecedent and petitioner no.7 is a woman and the informant alleges that on account of dispute relating to land, accused came and Sandeep assaulted by knife causing injury on head.
4. Learned counsel submits that petitioners have been falsely implicated in the instant case by the informant on account of dispute relating to land. It is further submitted that specific allegation of assaulting the informant is against Sandeep who is alleged to have assaulted the informant by knife causing injury on him. It is further submitted that from perusal of Annexure-2 to the anticipatory bail application i.e. the injury report of the informant, it would manifest that he suffered simple injury caused by hard and blunt substance, as such it is submitted that allegation of assault by knife gets belied. It is also submitted that only to give seriousness to the case, it is alleged that Sandeep assaulted by knife. It is further submitted that entire family members including female members have been implicated.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
6. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the
Patna High Court CR. MISC. No.49416 of 2025(2) dt.11-08-2025 3/3 event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned trial court where the case is pending/successor court in connection with Darauli P.S. Case No.109/2025, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
