Name of the petitioner came in this case in the confessional statement of co-accused Sanju Kumar Nishad who has already been granted privilege of bail by a coordinate bench of this court vide order dated 27.5.2015 passed in Cr. Misc. no.13954/2015. No doubt, petitioner carries criminal antecedent but it has specifically been pleaded on behalf of the petitioner that neither petitioner was caught on the spot nor anything was recovered from his conscious possession.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Railway Judicial Magistrate, Bettiah, West Champaran in Rail Motihari P.S. Case no. 02/2015. shahid (Hemant Kumar Srivastava,J) U T
