JUSTICE SANDEEP KUMAR ORAL ORDER 04-02-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is in custody since 31.03.2022 in connection with Rajnagar P.S. Case No. 71 of 2022 registered for the offence punishable under Sections 302, 201, 120(B) of the Indian Penal Code.

The deceased was having an affair with the petitioner no.2 and it is alleged by the informant that the petitioners have killed the deceased. There is no material directly to connect the petitioners with the killing of the deceased.

Accordingly, this application for regular bail is

Patna High Court CR. MISC. No.49174 of 2022(3) dt.04-02-2023 2/2 allowed.

In view of the aforementioned facts and circumstances, let the petitioner above named be released on bail after framing of charge if the charge in not framed yet or on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st Madhubani in connection with Rajnagar P.S. Case No. 71 of 2022.

The petitioner would cooperate in the proceeding of the Court below. If the petitioner tries to delay the trial, the Court below is at liberty to pass an appropriate order including the cancellation of bail bonds of the petitioner. The petitioner is directed to appear before the Court below through his lawyer or himself on each date, failing which, his bail bonds shall be cancelled.
