Petitioner seeks bail in a case registered for the offences punishable under sections 414 of the Indian Penal Code and section 25(1-b)A, 26 and 35 of the Arms Act. From the rented house of the petitioner two country made pistol of .315 bore, four live cartridges and a motor cycle, lap top were recovered.

It is submitted that the articles were not recovered from conscious possession of the petitioner. Petitioner was not an accused in any other case but after being arrested in this case, petitioner has been implicated in three more cases. Petitioner is in jail since 25.02.2015, i.e. for more than seven months.

Patna High Court Cr.Misc. No.45491 of 2015 (2) dt.30-09-2015 Considering the facts aforesaid, petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawadah in connection with Warisalignj P.S. Case No. 47 of 2015.
