The petitioner seeks bail in Chakiya P.S. Case no. 153/2014, registered for the offences punishable under Sections 364, 364A, 365 and 34 of the Indian Penal Code. The petitioner is not named in the FIR. Name of the petitioner figured in the case in the confessional statement of Ramesh Rai @ Rajesh Kumar. The victim did not identify the petitioner. Similarly situated co-accused, namely Phul Devi, Jitendra Sahni, Hariom Sahni, and Balendra Sahni have already been granted bail by different Benches of this Court. The case of the petitioner stands on the same footing.
Considering the facts aforesaid, the petitioner above named
Patna High Court Cr.Misc. No.40082 of 2015 (2) dt.08-09-2015 2/2 is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran, in connection with Chakia P.S. Case no. 153/2014.
