JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-09-2015 The matter has been listed out of turn on the prayer of learned counsel for the petitioners since the petitioners being the students have to appear in the ensuing examination of intermediate which is scheduled to be held from 03.10.2015 to 09.10.2015. A supplementary affidavit to that effect has been filed.

Heard learned counsels for the petitioners and the State.

The petitioners being the brother and unmarried sister of the husband of the victim are apprehending arrest in a case registered for the offences punishable under section 304B/34 of the Indian Penal Code.

Accusation is of killing the daughter of the informant by causing burnt injuries for non-fulfillment of dowry demand.

No.43056 of 2015 (2) dt.30-09-2015 2/2 It is submitted by learned counsel for the petitioners that as per own admission of the informant, the marriage was performed in 2007 and the victim died on 01.05.2015. Moreover, the victim received accidental burnt injuries for which she was given medical treatment and husband of the victim, in course of rescuing the victim, received 75 % of burnt injuries. Considering the fact that as per own admission of the informant the case does not come within the purview of section 304B of the Indian Penal Code, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Begusarai in connection with Nagar P.S. Case No.214 o f2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
