JUSTICE ARUN KUMAR ORAL ORDER 02-04-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody since 08.01.2018, seeks bail in connection with Banmankhi P.S.Case No. 04 of 2018 registered under Sections 307, 380 and 457/34 of the Indian penal Code.

Allegation in brief is that petitioner was caught red handed in the house of the informant while committing theft and also assaulted the informant.

Submission is that it is alleged that theft of some documents were committed in fact petitioner was labourer and the informant had due some labour charges to the petitioner so he has been falsely implicated in this case moreover, the police after investigation has submitted charge sheet only under Section 380 and 457 of the Indian Penal Code and not under Section 307 of the

Patna High Court Cr.Misc. No.18432 of 2018 (2) dt.02-04-2018 2/2 Indian Penal Code was found true and the petitioner has clean antecedent.

Having considered the aforesaid facts and circumstances, the petitioner, namely , Nandan Rishi @ Nandan Rishideo, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned ACJM-1st, Purnea in connection with Banmankhi P.S. Case No. 04 of 2018.
