JUSTICE MOHIT KUMAR SHAH ORAL ORDER 20-11-2018 The present writ petition has been filed for grant of pay protection from the date of initial appointment i.e. 01.01.1997 in terms of the order passed by a coordinate Bench of this Court dated 27.04.2000 in CWJC No. 1369 of 1999. The coordinate Bench of this Court vide the aforesaid order dated 27.04.2000 had directed that in case any person junior to the petitioner has been provided with more salary, the petitioner should be granted pay protection.
The learned counsel appearing for the respondents does not dispute the aforesaid position in law.
Having regard to the facts and circumstances of the case, it is directed that in case any person junior to the petitioner
Patna High Court CWJC No.18188 of 2017 (4) dt.20-11-2018 2/2 has been granted more salary, pay protection should be granted to the petitioner herein. The said decision is required to be taken within a period of eight weeks from today.
