The petitioner is in custody in a case registered under Sections 302, 201, 34 of the Indian Penal Code. It is alleged by the informant that he has solemnized the marriage of his daughter with Alok Kumar Ranjan on 20.4.2008. On 6.1.2015 at about 7.30 A.M. Alok Kumar informed the informant on his mobile that he has boarding his wife Rakha in Jehanabad Arwal bus in the morning at about 6 A.M. The informant wait her daughter but she did not come in Daudnagar bus stand till 3 P.M.. The he informed to Alok Kumar. At about 5 P.M., the petitioner and his younger brother came at the house of the informant and went to Aurangabad to search her. On

Patna High Court Cr.Misc. No.40221 of 2015 (3) dt.16-10-2015 2/3 7.1.2015 and 8.1.2015 the petitioner and his father not made contract. Then he came to in-law's house of his daughter and found the house was locked.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner is in custody since 21.7.2015. There is no allegation of tampering with the evidence against the petitioner. The deceased( wife of this petitioner) had left for her Naihar on bus. When she did not reach to the father then the petitioner and his father started searching her. When they could not find her, they filed a Sanha in the evening with the local police station on the same day i.e. 06.01.2015, which is evident from Annexure 3 to the supplementary affidavit. Subsequently, the informant got the present case after two days on 8.1.2015 against the petitioner and his family members. There is no eye witness to the allegation made by the informant nor any such circumstantial evidence to suggest the implication of the petitioner in the present case. It is further submitted that the petitioner may be released after completion of six months in custody from 21.07.2015. On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the facts aforesaid, let above named

Patna High Court Cr.Misc. No.40221 of 2015 (3) dt.16-10-2015 3/3 petitioner be released, after completion of six months in custody from 21.07.2015, on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M.,Jehanabad in Jehanabad P.S.Case No. 14 of 2015.
