====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 21-06-2021 Heard the parties in virtual Court proceeding. The petitioner is languishing in custody for the offences punishable under Section 376 of the I.P.C. and Section 4 of POCSO Act.
Learned counsel for the petitioner submits that victim does not appear to be reliable in the facts and circumstances of the case.
Considering the allegation against the petitioner of commission of rape against a minor girl and support of the aforesaid fact by the victim in her statement under Section 164 Cr.P.C., I am not inclined to enlarge the petitioner on bail. Hence, prayer for bail is refused in connection with Sono (Charkapathar) P.S. Case No. 171 of 2019 pending in the court
