Heard the learned counsel for the petitioner and the learned A.P.P. for the State. 2.
The petitioner apprehends his arrest in connection with Malsalami P.S. Case No. 434 of 2018, registered for the offences punishable under Sections 304(B), 120 (B) and 34 of the Indian Penal Code.

The case of the prosecution, in brief, according to the informant, is that the marriage of the daughter of the informant was solemnized with the petitioner on 21.06.2018 and during the course thereof huge sums of dowry was given, whereafter the daughter of the informant had gone to her

No.51039 of 2023(2) dt.19-08-2023 2/3 matrimonial home but the petitioner and his family members started demanding a four wheeler car and on account of non-fulfillment of the demand for dowry they used to torture and beat her and ultimately the accused persons including the petitioner herein had killed her by hanging her from a fan with her saree.

The learned counsel for the petitioner has submitted that the petitioner is innocent, he has been falsely implicated in the present case and he is having a clean antecedent. The learned counsel for the petitioner has further submitted that the daughter of the informant had committed suicide, hence the petitioner is having no complicity in the matter.

Per contra, the learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail.

I have heard the learned counsel for the parties and I find from the records that the petitioner is the main accused in the present case and prima facie he is responsible for the murder of

No.51039 of 2023(2) dt.19-08-2023 3/3 his wife, hence I am not inclined to at least grant the privilege of anticipatory bail to the petitioner especially since the investigation is still going on, which the petitioner is yet to join, thus the present petition stands dismissed.
