JUSTICE ARUN KUMAR ORAL ORDER 06-04-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Nasriganj P.S.Case No. 143 of 2017 registered under Sections 323, 341, 354B, 366A, 504 and 506 of the Indian penal Code and 4 and 6 of the Protection of Children from Sexual Offences Act.

Allegation in brief is that informant was enticed away by Rahul Kumar Paswan and brought her to his house thereafter he and the petitioner both raped her two days, thereafter she returned back to her home.

Submission is that petitioner seeks bail on the ground of parity as the similarly situated co-accused Rahul Kumar Paswan has already been admitted to bail by a co-ordinate Bench of this Court vide order dated 01.02.2018 passed in Cr. Misc. No. 5337 of

Patna High Court Cr.Misc. No.10498 of 2018 (3) dt.06-04-2018 2/2 2018 and on merit, it is submitted that the said occurrence is said to have taken place in presence of her younger sister, so the case ought to have been instituted soon after the occurrence but the FIR was lodged after delay of three days and also returned back herself.

Having considered the aforesaid facts and circumstances, the petitioner, namely, Lalu Singh @ Lallu Singh, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned 1st Addl. Sessions Judge, Rohtas Sasaram in connection with Nasriganj P.S. Case No. 143 of 2017.
