The petitioner apprehends his arrest in connection with Special Case No.4892 of 2019 corresponding to Maner P.S. Case No.252 of 2019, registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act. 5 litres of Mahua wine is said to have been recovered from the shop of the petitioner.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is further submitted that there is no recovery from the conscious possession of the petitioner rather 5 litres of Mahua wine has been recovered from the shop of the petitioner. Learned APP for the State opposes the prayer for

Patna High Court CR. MISC. No.59044 of 2021(2) dt.24-06-2022 2/2 anticipatory bail of the petitioner by submitting that the petitioner has got criminal antecedents of similar nature. Taking into consideration the fact that 5 litres of Mahua wine has been recovered from the sop of the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
