====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SRIVASTAVA ORAL ORDER 23-03-2023 Heard learned counsel for the petitioners, learned A.P.P. appearing on behalf of the State and learned counsel for the informant.

The petitioners apprehend their arrest in connection with Sirdalla P.S. Case No. 375 of 2021 registered under Sections 341, 223, 307, 302 and 34 of the Indian Penal. Learned counsel appearing on behalf of the petitioners submits that petitioners are innocent and have falsely been implicated in the present case due to village politics and pattedari dispute. Further submission is that there is no specific allegation against the petitioner nos. 1 and 2. There is only

No.49167 of 2022(6) dt.23-03-2023 2/2 allegation of assault against the petitioner no. 3 on the neck of Satya Devi by means of sharp cut weapon Phalkati, but no such injury has been found on the neck of Satya Devi. It is further submitted that petitioners have got no criminal antecedent. Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing personal bonds each to the satisfaction of the Additional Chief Judicial Magistrate-I, Nawada in connection with Sirdalla P.S. Case No. 375 of 2021, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
