2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 341, 342, 323, 324, 325, 307, 379, 120B and 504/34 of the Indian Penal Code, registered in connection with Paharpur P.S. Case No. 424 of 2023.

3. As per prosecution case, the allegation against the petitioner is that he pulled the informant's son from motorcycle while other co-accused persons started assaulting by means of

Patna High Court CR. MISC. No.51601 of 2024(2) dt.29-07-2024 2/3 iron rod, danda and knife to his son and also his nephew due to which they sustained injuries. It is further alleged that the accused persons have also snatched their mobile phones.

4. The learned counsel for the petitioner has submitted that petitioner has been falsely implicated in this case and has committed no offence. From reading the FIR, it appears that there is no allegation of assault attributed against the petitioner rather the allegation of assault is against co-accused persons. The only allegation against this petitioner is that he pulled the informant's son from motorcycle, implicated in this case. Petitioner is a person of clean antecedent and he is in custody since 21.10.2023.

5. Learned APP for the State has opposed the prayer of bail.

Considering the above facts and circumstances of the case, petitioner having clean antecedent as well as period of custody undergone by him, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-13, East Champaran, Motihari in connection with Paharpur P.S.
