The petitioner apprehends his arrest in Buxar Town P.S. case No. 193/2016 under Section 222, 223 of the Indian Penal Code and under Section 66 of the Excise Act.
The allegation against the petitioner is that he let off two persons, who were earlier apprehended by the Superintendent, Excise and kept in Hazat, without the order of the superior authorities.
The learned counsel for the petitioner submits that Section 222 and 223 of the IPC are bailable and Section 66 of the new Excise Act is also bailable and only three months punishment is prescribed for the Excise officials who do not obey the order of
Patna High Court Cr.Misc. No.24831 of 2016 (3) dt.11-08-2016 2/2 the superior Excise officials.
Considering the facts aforesaid, this anticipatory bail petition is permitted to be withdrawn.
Accordingly, this anticipatory bail petition is disposed of as withdrawn.
