1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 118(2), 109(2) and 3(5) of the BNS.
3. Learned counsel for the petitioners submits that petitioner no. 1 is a person with clean antecedent and petitioner no. 2 has antecedent of one case and in sum and substance, the allegation in the FIR is that petitioner no. 1 along with Jabbar and Rahim snatched the motorcycle of the informant and thereafter on instruction of Abid Hussain, Kamal, Jabbar and Rahim inflicted sword and knife blow on the chest of the informant and his friend Anish Roy with an intention to kill them. It is further submitted that Abdul Jabbar @ Jabbar had moved this Court seeking
Patna High Court CR. MISC. No.49453 of 2025(2) dt.11-08-2025 2/2 anticipatory bail by filing Cr. Misc. No. 41542 of 2025 and the same was allowed by an order dated 09.07.2025 by a learned Coordinate Bench of this Court. It is next submitted that case of the petitioners is on a better footing than Abdul Jabbar @ Jabbar as petitioners are not alleged to have assaulted the injured by sword and knife.
4. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
5. Considering the submissions made by the learned counsel for the petitioners and also taking into consideration the order dated 09.07.2025 in Cr. Misc. No. 41542 of 2025, let the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/Successor Court in connection with Pothia P.S. Case No. 57 of 2025, subject to the conditions as laid down under Section 482(2) of the BNSS.
