JUSTICE DINESH KUMAR SINGH ORAL JUDGMENT (Per: HONOURABLE THE ACTING CHIEF JUSTICE) Date: 12-01-2017 The petitioners have prayed for investigations by special agency into the Intermediate examination process (for short, 'the merit scam').

It is the stand of the State that special investigation team has been constituted to investigate the merit scam. The Chairman and the Secretary of the Board have been removed. It is also pointed out that action has been taken against large number of other employees

Patna High Court CWJC No.11514 of 2016 dt.12-01-2017 2/2 of the Board, who have been found to be involved in the merit scam. Even students, who were beneficiary of the merit scam and the management of the school/college, have also been made liable and the results of the topper candidates in such merit scam have been cancelled.

In view of the counter affidavit, we are satisfied that the State has taken sufficient steps for the investigation of the merit scam. Since the matter is pending investigations, it is for the investigating agency to find out the role of high and mighty and arrive at an appropriate conclusion for the purpose of trial in accordance with law.
