The petitioner apprehends his arrest in connection with Shikarpur P.S. Case No. 380 of 2021 registered under Section 30(a) of Bihar Prohibition and Excise Act. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case due to ulterior motive and police mechanism. Further submission is that on perusal of seizure list, it appears that the alleged recovery of illicit liquor has been made from the open Verandah. Nothing has been recovered from the conscious possession of the petitioner. Having considered the facts and circumstances of the

Case No. 380 of 2021, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
