JUSTICE ARUN KUMAR ORAL ORDER 01-02-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Dholbajja (Kadwa) P.S.Case No. 64 of 2017 registered under Sections 447, 341, 326, 307, 504, 506/34 and 302 of the Indian Penal Code and Section 27 of Arms Act.

Allegation in brief is that Raja Mandal along with this petitioner went to the house of informant and Raja Mandal shot at informant who later on died due to injury.

Learned counsel for the petitioner submits that due to enmity, petitioner has also been implicated being brother of Raja Mandal and allegation of killing is against Raja Mandal and not against this petitioner and he is in custody since 18.09.2017 having no criminal antecedent and police has submitted charge sheet.

No.4216 of 2018 (2) dt.01-02-2018 2/2 Having considered the aforesaid facts and circumstances, the petitioner, namely , Nitish Mandal @ Nitish Kumar Mandal, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Mr. D.K.Yadav, J.M., 1st class, Naugachia, DistrictBhagalpur in connection with Dholbajja (Dadwa) P.S. Case No. 64 of 2017.
