1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in a case registered for the offences punishable under Sections 30(a), 32(2), 32(3), 41(i)(ii) of the Bihar Prohibition and Excise (Amendment) Act, 2018 & 2022.

3. The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and allegation is of recovery of 500.250 liters of liquor from two vehicles for which 455.25 liters of liquor is alleged to have been recovered from the car which the petitioner was driving.

4. The learned counsel for the petitioner submits that petitioner was driving the vehicle and is not the owner of the

Patna High Court CR. MISC. No.52384 of 2024(3) dt.06-09-2024 2/2 vehicle and as such was not aware that what kept on the vehicle i.e. Tata 407 by the consigner. It is next submitted that petitioner is in custody since 17.05.2024.

5. The learned APP for the State opposes the regular bail application.

6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named is directed to be released on bail on his furnishing bail-bonds in the sum of Rs.10,000 /- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Judge 1st Begusarai in connection with Begusarai Town P.S. Case No. 254 of 2024.

7. The application stands allowed.
