The petitioner is in custody in a case registered under Sections 302/34 of the Indian Penal Code and Section 27 of Arms Act.

It is alleged that the petitioner and others fired upon the husband of the informant as a result of which he died. On behalf of the petitioner it has been submitted that the petitioner is in custody since 27.5.2015. Charge sheet has been submitted in this case . There is no allegation of tampering with the evidence against the petitioner. General and omnibus allegation has been made against the petitioner. There is no eye witness to the occurrence. Other co-accused has been granted bail

Patna High Court Cr.Misc. No.39480 of 2015 (3) dt.13-10-2015 2/2 by this Court, vide Cr. Misc. No.34978 of 2015. On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the facts aforesaid, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Saharsa in Bakhtiyarpur (Balwahat O.P.) P.S.Case No.169 of 2015.
