Mr.Meena Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 06-08-2019 Heard the learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners seek bail in Barachatti P.S. Case No. 215/2019, instituted for offence under Section(s) 30(a), 38 and 47 of the Bihar Prohibition and Excise Act.

It is alleged that 120 litres of Beer has been recovered from the dickey of Indigo vehicle. Petitioner no. 1 was driving the vehicle and petitioner no. 2 was sitting in the aforesaid vehicle.

Learned counsel for the petitioner has submitted that there is no recovery of any illicit liquor from possession of petitioners rather mobile phones were recovered from their

The other co-accused persons have already been granted bail by this Court vide order dated 10.07.2019 passed in Cr. Misc. No. 41549/2019.

Petitioners are in custody since 28.05.2019 having clean antecedent.

Considering the aforesaid facts and circumstances, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Gaya, in connection with Barachatti P.S. Case No. 215/2019, subject to the conditions that both the bailors shall be the close relative of the petitioners. (Sanjay Priya, J) rakhi/- U T
