Petitioners seek bail in Darbhanga Town P.S. Case No.104 of 2019 instituted for the offence under Section(s) 30(a) of Bihar Prohibition and Excise Act, 2018.
Counsel for the petitioners submits that there is no recovery from conscious possession of the petitioners. As per seizure list, recovery has been made from the rented house of Ajay Choudhary.
It is mentioned in the written report that petitioners have been arrested because they were found standing near the house.
Counsel for the petitioners submits that Petitioners are
Patna High Court CR. MISC. No.48232 of 2019(2) dt.08-08-2019 2/2 in custody since 29.05.2019 having clean antecedents. In the facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the ADJ II cum Special Judge, Excise, Darbhanga, in connection with Darbhanga Town P.S.
