JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-12-2018 Heard Mr. Sunil Kumar, learned counsel for the petitioner and Mr. Prabhat Tekriwal, learned counsel for F.C.I. The present writ application has been filed for payment of statutory interest to the petitioner on delayed payment of gratuity amount, calculated for the period from 01.02.2013 to 05.08.2016.

It is submitted by learned counsel for the petitioner that the petitioner retired from the post of Manager (Depot), F.C.I. on 31.01.2013, but the gratuity amount was paid in the year 2016, i.e., three years after his retirement.

Patna High Court CWJC No.5616 of 2017(2) dt.03-12-2018 2/2 Learned counsel for the F.C.I. submits a decision with regard to payment of statutory interest on delayed payment of gratuity will be taken within a time frame.

In the circumstances, it is expected from the petitioner to submit a representation before Respondent No.3, the General Manager (Bihar), F.C.I. within a period of three weeks from the date of receipt of a copy of this order, whereupon it is expected from the concerned authority to take a decision with regard to consequential payment within a period of six weeks of submission of representation.
