JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 06-11-2023 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. Informant is appeared in person before this Court. It appears vide order dated 08.08.2023, that petitioner was granted provisional bail by another Bench of this Court.

Learned counsel appearing on behalf of the petitioner submitted that petitioner is ready to keep his wife with dignity and honour but it is the informant who does not

No.49782 of 2023(4) dt.06-11-2023 2/3 want to live the conjugal life with the petitioner. learned counsel for the informant submitted that petitioner assaulted the informant and there is life threat to live with this petitioner in such situation, it is submitted by learned counsel for the informant that informant seeks some maintenance for her survival as she is a housewife and she is unable to maintain herself.

Learned counsel for the petitioner, on instructions, submitted that petitioner is ready to give Rs. 5,000/- (five thousand) per month as maintenance from this month, subject to furnishing bank account number by the informant to the petitioner.

Learned counsel for the informant is directed to furnish account number of the informant to the petitioner within a period of one week from today.

On receipt of the bank account number of the informant, the petitioner shall deposit Rs. 5,000/- (five thousand) every month commencing from November, 2023 as maintenance in the account furnished by the informant. The aforesaid payment will subject to any order passed in the maintenance case for final settlement. Having heard learned counsel for the parties, the

Patna High Court CR. MISC. No.49782 of 2023(4) dt.06-11-2023 3/3 provisional bail granted to the petitioner vide order dated 08.08.2023 is hereby confirmed.

The application stands allowed.
