====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 21-08-2024 Heard learned Counsel for the petitioner and learned APP for the State.

2. The petitioner is apprehending arrest in connection with Dhansoi P.S. Case No. 62 of 2024 registered on 08.05.2024 for the offences punishable under Sections 341, 323, 307, 379 and 504/34 of the Indian Penal Code.

3. As per prosecution, the FIR has been lodged against two named accused persons including the present petitioner against whom there is specific allegation that he has abused the informant and attacked on the head of the informant by danda, causing head injury.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He submits that for the same date and place of occurrence there is a case and

He submits that the counter case has been filed by the petitioner in the form of Complaint Case No. 481 of 2024 under Section 438 of the Cr.P.C. He submits that the petitioner is not having any criminal antecedent. He further submits that both the informant and petitioner sides are well-known to each other and both are not criminals; rather due to petty village dispute the scuffle took place between both the parties which resulted into case and counter case.

5. Learned APP for the State opposes the prayer for bail of the petitioner.

6. In the facts and circumstances, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of 6 weeks from today, on furnishing bail bond of ₹30,000/- (thirty thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Buxar, in connection with Dhansoi P.S. Case No. 62 of 2024, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
