JUSTICE ARUN KUMAR ORAL ORDER 15-01-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Madhepura PS Case No. 206 of 2017 registered under Section 392 of the IPC. Learned Counsel for the petitioner submits that the FIR is against unknown and except disclosure of the name of the petitioner in the confessional statement made by co-accused persons, there is no other material against him. Neither the looted motorcycle was recovered from his possession nor he was put on TIP. The police has submitted charge-sheet and the petitioner is in custody since 2.8.2017.

Having considered the said facts and circumstances, the petitioner, namely, Amit Yadav @ Amit Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Madhepura in connection with Madhepura PS Case No. 206 of 2017 with the condition that the petitioner will remain present before the trial court on each date in the trial and in case of his absence on two consecutive dates without medical emergency his bail bonds shall be liable to be cancelled.
