The petitioner seeks bail in a case registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code and under different Sections of the Arms Act. The petitioner was on bail but he frequently misused the privilege of bail. The case was fixed for defence argument, but neither the argument was made nor the accused persons including the petitioner were present. The bail bond of the petitioner was cancelled on 07.04.2011. The petitioner again jumped out and misused the privilege of bail. The petitioner is in jail since 03.08.2015 and has already remained in jail for one month for misusing the privilege of bail.

No.40491 of 2015 (2) dt.03-09-2015 2/2 Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge 2nd, Kishanganj in Sessions Trial No. 192 of 2007, arising out of Kochadhaman P.S. Case No. 44 of 2006, subject to the condition that if the petitioner fails to appear even on a single date during the trial, the trial court shall cancel the bail bond of the petitioner.
