The petitioner has filed the instant application for grant of regular bail in connection with Bajpatti P.S. Case no. 320 of 2020 registered under sections 379, 414 and 34 of the Indian Penal Code.

As per allegation in the FIR, while one of the accused persons managed to steal the vehicle of the informant, the other accused who happens to be the petitioner herein was caught. It is submitted by learned counsel for the petitioner that the allegations as leveled in the FIR are false and concocted. The petitioner was arrested as a result of misunderstanding. No incriminating article has been recovered

Patna High Court CR. MISC. No.5234 of 2021(5) dt.26-07-2021 2/2 from his possession. He has no concern with the coaccused. He is in custody since 10.8.2020 and in the other case he has already been enlarged on bail.

The application for bail is opposed by learned Additional Public Prosecutor for the State.

Having heard learned counsel for the parties and taking into consideration the petitioner having remained in custody for over 8 months and investigation in the case having concluded, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Bajpatti P.S. Case no. 320 of 2020 on furnishing bail bond of Rs. 10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned SubDivisional Judicial Magistrate, Pupri, Sitamarhi.
