====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-08-2023 Heard learned counsel for the petitioners and the State.
2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 147, 149, 323, 325, 337, 338, 307, 379, 354, 427, 341, 448, 504 and 506 of the Indian Penal Code.
3. Allegation against these petitioners is of commission of assault to the informant and his family members by means of iron rod, lathi and danda on account of which seven persons sustained injuries.
4. It is submitted that the injuries allegedly caused by the petitioners are found to be simple in nature. Case and
Patna High Court CR. MISC. No.51130 of 2023(2) dt.18-08-2023 2/2 counter case. Admittedly, the occurrence took place due to dispute between the parties over the passage. Petitioners have got clean antecedent.
5. Considering the simple nature of injuries, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Gaya in connection with Aanti P. S. Case No. 15 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
