The petitioner apprehends his arrest in Gardanibag P.S. Case No.470 of 2018, registered under Sections 452, 341, 342, 323, 307 and 34 of the Indian Penal Code. The informant alleged that petitioner Mukul Kumar and one Anand Kumar assaulted his son by dashing his head against the wall and they fled away after his son became unconscious.

Learned counsel for the petitioner submits that the son of the informant was admitted in N.S. Hospital but the doctor did not find any external or internal injury. The injury report is annexed in para 25 of the case diary which shows that there was no external injury nor any fracture was found. The patient was stable and after four hours, he was discharged.

No.48092 of 2019(3) dt.30-09-2019 2/2 Taking into consideration the facts that no apparent injury was found on the person of the son of the informant on account of assault alleged to have been made by the petitioner, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Judge-XIVth-cum-A.C.J.M., Patna in connection with Gardanibag P.S. Case No.470 of 2018, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
