The petitioner seeks bail in anticipation of his arrest in connection with Excise Case No. 1182 of 2020 arising out of Agion Bazar P.S. Case No. 89 of 2020 instituted for the offences under Section 30 (A) of the Bihar Prohibition and Excise Act.

On secret information that the the petitioner and one Ramdeo Singh @ Bhulan Singh are dealing in liquor, a raid was conducted. A vehicle was intercepted and Ramdeo Singh @ Bhulan Singh was arrested whereas the petitioner managed to run away. From the vehicle, 414 litres of IMFL

Patna High Court CR. MISC. No.5011 of 2021(2) dt.10-09-2021 2/2 was recovered.

Learned counsel for the petitioner has submitted that the accusation against him is absolutely false and is the handy work of the police.

However, regard being had to the fact that the regular bail application of the arrested accused person, namely, Ramdeo Singh @ Bhulan Singh has been rejected, I am not inclined to grant anticipatory bail to the petitioner. The prayer for anticipatory bail is rejected. However, if the petitioner surrenders before the court below and seeks bail, it shall be considered on its own merits, taking into account that that the petitioner was not arrested on the spot and that he has clean antecedents and an order shall be passed without being prejudiced by the fact that the present petition on his behalf has not been entertained.
