Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual mode.

The petitioner seeks regular bail in connection with Nautan P.S. Case No. 397 of 2020 lodged under Sections 413, 414 of the I.P.C. and Section 30(a) of the Bihar Prohbition and Excise Act, 2018.

As per the prosecution case, total recovery of 335 liter of liquor is subject matter of the present case. Learned counsel for the petitioner submits that from the seizure list it transpires that the said recovery has been made from the bush situated near Shivrajpur dam. He further submits that petitioner is in custody since 26.05.2022. He also submits

Patna High Court CR. MISC. No.49113 of 2022(2) dt.11-11-2022 2/2 that nothing was recovered from the possession of the petitioner. Learned counsel submits that other co-accused of this case has been granted bail vide order dated 20.06.2022 in Cr. Misc. No. 58521 of 2021.

Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, Excise, Bettiah, West Champaran, Bihar in connection with Nautan P.S. Case No. 397 of 2020, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

With this observation, the bail application stands allowed.
