2. In the present case, the petitioner seeks bail in connection with Chakiya P.S. Case No. 13 of 2025 registered on 14.02.2025 for the offences under Sections 25(1-b)a and 26 of the Arms Act.

3. As per prosecution case, petitioner was apprehended with loaded country made katta and one live cartridge apart from four live cartridges.

4. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Petitioner has not committed any offence. Nothing incriminating has been recovered from the possession of this petitioner who has been falsely implicated in

Patna High Court CR. MISC. No.47413 of 2025(2) dt.30-07-2025 2/3 this case and a number of cases at the instance of local Mukhiya with whom the petitioner is having inimical terms. Even the long list of criminal history of the petitioner is also one of the reasons for implicating him in this case. Petitioner is in custody since 15.02.2025 and charge-sheet has been submitted.

5. Learned A.P.P. opposes the submission made on behalf of the petitioner. Learned APP submits that petitioner is having antecedent of 23 cases and he is a habitual offender.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the period of custody of the petitioner along with submission of charge-sheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai/concerned court in connection with Chakiya P.S. Case No. 13 of 2025, subject to the conditions mentioned in Section 480(3) of the B.N.S.S. and other following conditions:

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
