2. The petitioner has prayed for bail in a case instituted for the offence under Sections 302 and 34 of the Indian Penal Code and Section 27 of the Arms Act, later on Sections 25(1-b)a, 35 and 26/35 of the Arms Act has been added.

3. This is the second attempt of bail by the petitioner as earlier his prayer was rejected by a Co-ordinate Bench vide order dated 16.01.2024 passed in Cr. Misc. No. 58869 of 2023.

4. Learned counsel for the petitioner submits that the petitioner is renewing his prayer for bail on the ground of delay in proceeding of the trial.

5. A report with regard to the stage of trial was called for from the Court below which shows that the charges were

Patna High Court CR. MISC. No.51603 of 2024(3) dt.26-10-2024 2/2 framed against the petitioner on 17.03.2023 and bailable warrant were issued to procure the attendance of the witnesses but not a single witness turned up till date.

6. In view of the above, this application is disposed of with an observation to the trial Court to expedite the trial and dispose of the case within a period of one year, failing which the petitioner will be at liberty to renew his prayer for bail. (Nawneet Kumar Pandey, J) Arish/- U T
