2. The petitioner apprehends his arrest in a case registered for the offence under Sections 272, 273 of the I.P.C. and Sections 30(a), 30(c) of Bihar Prohibition and Excise Act.

3. 10 liters of illicit liquor has been recovered from the bank of Gopalpur river.

4. It is submitted on behalf of that recovery has been made from a public place and petitioner has been made accused only on suspicion.

5. However, learned A.P.P. for the State vehemently opposed the prayer for anticipatory bail and submitted that petitioner has got one criminal antecedent of similar nature.
