2. The petitioner is in custody in connection with Khaira P.S Case No. 216 of 2024 registered for the offences punishable under Sections 309(4) B.N.S.
3. As per allegation in the FIR, four person including the petitioner has looted articles of the petitioner including the motorcycle bearing Registration No. BR0450334 and Cash of Rs. One Lakh 27 Thousands on the point of fire arm and fled away towards Nagara.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next
Patna High Court CR. MISC. No.48229 of 2025(3) dt.08-10-2025 2/3 submits that petitioner is not named in the FIR and moreover, he was not put up on TIP. He further submits that no incriminating article which is subject matter of the present case was recovered from the possession of this petitioner. Petitioner's name has been figured from the confessional statement of co-accused Ajay Kumar. He further submits that charge-sheet has already been submitted. It is also submitted that petitioner is in judicial custody since 08.04.2025 having seven antecedent of similar nature.
5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.

On perusal of the FIR, case diary and impugned order dated 25.06.2025, it appears that petitioner's name has been figured from the confessional statement of the coaccused namely Ajay Kumar and moreover, petitioner is not named in the FIR. TIP has not been conducted till now by the Officials concerned. So, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Saran at Chapra in connection with Khaira P.S.
