JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-07-2019 This application, for grant of anticipatory bail, arises out of Naubatpur P.S. Case No. 206/2019, disclosing offences under Sections 302, 120B and 34 of the Indian Penal Code. Prosecution story disclosed that the wife of the informant was shod dead by co-accused Pappu Singh and petitioner is alleged to be one of the conspirators in the murder of the wife of informant.
Submission of learned counsel for the petitioner is that the petitioner has been made accused in this case only because, she happens to be mother of co-accused Pappu Singh and except that there is nothing against the petitioner. Heard learned A.P.P. also.
Having heard both sides, considering the facts and circumstances of the case, this application is allowed. Let the
Patna High Court CR. MISC. No.46473 of 2019(2) dt.26-07-2019 2/2 petitioner, above named, in the event of her arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -II, Danapur, Patna in connection with Naubatpur P.S. Case No. 206/2019, subject to the condition laid down under Section 438
(2) of the Code of Criminal Procedure.
